Inclusive Reading Technologies Interim License

Notice: during the development of the specifications listed in this repository, this license shall be time-limited and temporary, the terms of which shall extend no more than one year past the most recent editor's draft publication date of this material.

Upon finalization of a final recommendation by this organization, or by specific other organizations, the terms of this license shall change to reflect that (future) status as a public recommended guideline or standard.

Nothing in this license extends to any trademarks or patents (pending or issued). Any potential patent licensing is a separate matter, not covered within this document.

This license and permission to use any of the materials contained herein, being beta material, is revocable at any time by Inclusive Reading Technologies, Myndex Research, authorized officers, agents, or assigns.

PREAMBLE

The development of software and specific specifications relating to important factors in design particularly those relating to accessibility and readability, is a complicated, nuanced, and challenging journey.

To encourage the development and continue testing and research, this public license was developed. The intention is to allow the non-commercial use and experimentation with the concepts specifications and code related to this and other projects herein, but to restrict the ill-advised use in inappropriate situations, and to restrict the modification of code or specifications for commercial work or for applications that rightly require special consideration such as medical, clinical, transportation, aerospace, automotive, military, and any place where human safety is a considered factor.

Therefore, the code and specifications in this repository are limited to experimental non-commercial work, research work, and academic work, with the understanding that this license may be revoked at any time when it is deemed necessary by the organization, in order to ensure public health or safety, or to eliminate misunderstandings relating to the intellectual property contained within this repo and related repositories.

IN SHORT THIS MEANS:

  • You may use the materials in this repository for your own use and purposes, including the internal use or purposes for your organization.
  • You may submit issues comments import requests herein to discuss or provide alternate versions for consideration.
  • You may use the materials herein for noncommercial tools, or products which are available on a non-commercial basis provided that:

TERMS AND CONDITIONS

0. DEFINITIONS.

"THIS LICENSE" refers to version 6 of the Myndex General Public License for public beta projects.

"COPYRIGHT" extends to copyright-like laws that apply to other works.

"CONTENT" refers to any work licensed herein. Further, "THE WORK" generally refers to the content that is protected by this license.

"YOU" refers to each individual licensee.

"LICENSEES" and/or "RECIPIENTS" may be individuals or organizations.

To "MODIFY" a work means adapt all or part of the work in a manner requiring copyright permission, other than making an exact copy. The resulting work is called a "derivative work" or a "modified version" of the the work or a work "based on" the earlier work.

A "COVERED WORK" means either the unmodified Content or a derivative work based on the Content.

"PROPAGATE WITHOUT PERMISSION" means actions or efforts that would make you directly or vicariously liable for infringement under applicable copyright law. Propagation includes, but is not limited to, any form of copying, duplication, modification, distribution, public disclosure, and in some jurisdictions other liabilities as well.

"APPROPRIATE LEGAL NOTICES" means a human readable notice that copyright notice, and forms the user that there is no warranty expressed nor implied for the use or misuse of any of the constant, cold, or subsequent applications thereof, with the exception of the extent such warranties may be provided separately.

1. SOURCE CODE.

"Source" and "Source code" refers to work and what is normally considered a human readable, and human editable form.

"Object" and "Object code" refers to any non-source form of a work, such as compiled code, or textual material that is encoded in a normally non-editable form such as a PDF or an image.

2. BASIC PERMISSIONS.

All rights granted under this License are granted for a specified and limited term, separate from the copyright on the Content, and is revocable by notice.

You may make, run, use, examine, and experiment with covered works, provided that you do not distribute or exploit them publicly, so long as your license is in force. You may privately convey covered works to others for the sole purpose certain collaborations exclusively with you, or to provide you with facilities for using those works, provided that you comply with the terms of this License in taking reasonable care to ensure that other collaborators are similarly informed of the stipulations of the license.

3. TERMINATION.

5. DISCLAIMER OF WARRANTY.

THERE IS NO WARRANTY FOR THE CONTENT. EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDERS AND/OR OTHER PARTIES PROVIDE THE CONTENT AND/OR WORKS "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

6. LIMITATION OF LIABILITY.

7. SECTIONS 5 AND 6.

If the disclaimer of warranty and limitation of liability provided above do not meet the requirements of a local regional law, reviewing courts shall apply law that most closely approximates an absolute waiver of all civil liability in connection with the Content.
